An owner hires a contractor to build a new commercial building in 2 years for $50 million. 4 years and $75 million later a construction dispute arises. The owner has lost use of the building for 2 years and the contractor has not been paid for $25 million of work. Both parties go to court over the dispute.
To decide the case, the finder of fact is going to want to know:
- What delayed the project for 2 years?
- Who is responsible for those delays?
- What are the additional costs associated with those delays?
- Who should pay whom?
The contractor or owner may be asking themselves:
- What could I have done to have prevented this from happening in the first place?
